General Terms and Conditions

1. Deliveries and Services

All deliveries and services resulting from online orders placed via the Internet are subject to these general terms and conditions. Any deviating or supplementary agreements require the express consent of JUWELIER PERNTER DI PERNTER P. & C. SAS, Via Kennedy 154, 39055 Leifers / Laives (BZ), Italien(hereinafter "we"), as well as written form. A legally valid purchase contract is concluded upon receipt of your order by us and our acceptance (by telephone, by e-mail or by ordering in our online shop).

We are an official authorised dealer of, among others, the brands Harley Davidson by Bulova, Bulova, Citizen, Bering, Casio, Festina, Lotus by Festina, GreenTime by Zzero, Mondia and Aquaforte Vicenza. All products sold in our online shop are original goods, delivered with the original packaging, the corresponding original manufacturer's warranty certificate, the instructions for use and the proof of purchase from our shop.

2. Online Orders

We process incoming online orders without delay and dispatch them as quickly as possible. The goods in our online shop are generally available for immediate delivery unless stated otherwise in the product description. Delivery dates are non-binding.

3. Prices

Our prices are stated in euros, include the statutory value added tax (IVA) of currently 22% and do not include shipping costs. We endeavour to guarantee the prices stated in the online shop over the long term. Price corrections, both upwards and downwards, are possible if this becomes necessary. The price displayed at the time of the order is binding. Any shipping costs are shown separately before the order is completed.

4. Payment

We offer the following payment methods:

• Card payment via the payment service provider Stripe (credit and debit cards, Apple Pay, Google Pay)
• PayPal
• Prepayment by bank transfer: after placing your order you will receive our bank details and your order number as the payment reference by e-mail. The goods are dispatched once payment has been received.

Prepayments are due within 7 days without deduction, unless otherwise agreed. Offsetting is only permitted against undisputed claims or claims established by a final court judgment. You may only exercise a right of retention insofar as it is based on the same contractual relationship.

We are a retail business and therefore sell only to end consumers. For all purchases made, we issue the corresponding proof of purchase from our shop and enclose it with the order upon dispatch.

5. Object of Purchase and Retention of Title

The object of purchase remains our property until full payment of all claims arising from the contractual relationship between you and us.

6. Shipping

We ship exclusively with insured shipping via the courier service Bartolini (BRT) and only to EU countries. We do not deliver to Switzerland. From an order value of €300.00 we deliver free of shipping costs to all EU countries. The shipping costs per country can be found under Shipping.

We dispatch the goods once payment has been received. Someone must be present at the delivery address to accept the delivery. Please check the delivery for completeness and damage upon receipt. Please assert any complaints regarding transport damage directly with the transport company within the applicable deadlines and inform us as well. We expressly point out that delivery times do not depend on us.

7. Complaints

Complaints regarding the scope of delivery, material defects, incorrect deliveries and quantity deviations must be asserted in writing without delay, but no later than within one week of receipt of the goods. In the case of justified complaints, we will make a subsequent delivery and, beyond that, at our discretion, exchange the goods, take them back or grant you a price reduction. If, in the case of an exchange, the second replacement delivery is also defective, you have the right to withdraw from the purchase contract. Your statutory rights as a consumer remain unaffected.

8. Returns

Returns can be made within 14 days of receipt of the goods. For the return you need a return number and a copy of the proof of purchase. Please contact us before returning the goods in order to receive a return number. Returns without a return number will not be accepted and will be sent back immediately at the buyer's expense. Incorrect deliveries will only be taken back in undamaged, unmarked original packaging that is complete in all its parts and free of adhesive labels. Returns are only accepted if the description of the defect has been communicated in advance. We reserve the right to carry out a product inspection. If goods are returned to us as faulty or defective without justification, we will charge 50.00 euros for the inspection plus freight costs. We reserve the right to replace a returned defective product with an identical or equivalent product or to issue a credit.

Your statutory right of withdrawal as a consumer remains unaffected by this and is not tied to any of these conditions - see Withdrawal.

9. Non-Acceptance of Goods

Ordered goods that are not accepted entitle us to terminate the contract and to assert a claim for damages amounting to 20% of the net order value plus handling costs of 12.40 euros plus VAT. The purchase contract is concluded upon submission of the online order and our acceptance. By submitting the order, you accept these terms and conditions.

Your statutory right of withdrawal remains unaffected by this: if you withdraw within the deadline, you will not incur any damages or handling costs.

10. Right of Withdrawal

As a consumer, you are entitled to a 14-day right of withdrawal. The period begins upon receipt of the goods. The withdrawal can be declared in writing, via our withdrawal button or by returning the goods. After receipt of the returned goods, we will refund the purchase price. The returned goods must be complete (original box including its contents) and in unused, undamaged condition. You only have to pay compensation for any deterioration of the goods if it is attributable to handling that goes beyond examining their characteristics and functioning - that is, beyond what would be possible and customary in a physical shop.

11. Warranty, Liability and Repairs under Warranty

The statutory legal guarantee of conformity (garanzia legale di conformità) of 24 months from receipt of the goods applies. In addition, the warranty conditions of the respective manufacturer apply to the products sold. Service and warranty work is carried out by the manufacturers at one of their service centres. To the extent permitted by law, we accept no liability for consequential damage caused by defective products or delayed deliveries. Further details under Warranty & Returns.

12. Vouchers

We may issue vouchers to our customers. All vouchers must be redeemed within the periods stated in each case. Cash payment or crediting of the voucher amount to an account is excluded. Each voucher can only be redeemed once per customer.

13. Data Protection

We collect, store and process the personal data required in the context of the business relationship. Your data is handled in accordance with the EU General Data Protection Regulation (GDPR, Regulation No. 679/2016). All information on this can be found under Privacy Policy. 14. Applicable Law & Jurisdiction

Italian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected. The court of Bolzano (Italy) has jurisdiction over legal actions, unless mandatory statutory provisions provide for a different place of jurisdiction.

15. Consumer Dispute Resolution

For consumer disputes arising from a contract in connection with the online purchase of goods and services between us and a consumer, we already guarantee our participation in the alternative dispute resolution (ADR) procedure at conciliare.it.

The complaint can be submitted via the website www.conciliare.it. In the case of complaints, please first contact us directly at shop@juwelierpernter.com - a solution is usually found quickly.

Note: the former Online Dispute Resolution platform (ODR platform) of the European Commission was discontinued on 20 July 2025 and is no longer available.

16. Miscellaneous

Errors, incorrect technical information and typographical errors are reserved.

Consumer Information under Distance Selling Provisions

1. Our delivery and business conditions apply to shipping to all EU countries.
2. The stated product prices include the value added tax applicable in Italy of 22%.
3. You can pay for your ordered goods by card payment (Stripe), PayPal or prepayment by bank transfer.
4. The stated shipping information and shipping costs apply.
5. The purchase contract becomes effective upon submission of the order and our acceptance. Our terms and conditions as well as the consumer information must be accepted before completing the order process; otherwise an order is not possible.
6. As a consumer, you have the option of returning the ordered goods within 14 days. The period begins upon receipt of the goods and of this instruction. Timely dispatch is sufficient to meet the deadline.
7. The return or return shipment is at the buyer's expense.
8. In the event of a return, please send the goods back with sufficient postage and state the invoice number, the return number and your address.
